By accessing and using the Mind Wellness application, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety. Your use of our service constitutes your acceptance of these terms. If you do not agree with any part of these terms, you must cease using the application immediately.

Mind Wellness reserves the right to modify these terms at any time. Continued use of the application after any such modifications constitutes your acceptance of the updated terms. We will notify users of significant changes via email or through the application.

You represent and warrant that you are at least 18 years of age or the age of majority in your jurisdiction, whichever is greater. Users under 18 must have parental consent and supervision. Mind Wellness is not intended for children under 13 years of age.

You agree to provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your account credentials and password. Any activity that occurs under your account is your responsibility, and you agree to notify us immediately of any unauthorized access or security breach.

You may create one personal account for your use only. Commercial accounts, automated access, or account sharing is prohibited. Mind Wellness may suspend or terminate accounts that violate this policy without warning.

Your account is personal and non-transferable. You agree not to sell, gift, or transfer your account to any third party. Any attempt to do so will result in immediate account termination and potential legal action.

Mind Wellness reserves the right to refuse service to anyone for any reason. We maintain the right to delete inactive accounts after 24 months of inactivity.

Users agree to use the Mind Wellness application responsibly and ethically. You are solely responsible for the content you upload, share, or create within the application. You must ensure all content complies with applicable laws and these terms.

You agree to treat other users with respect and professionalism. Harassment, discrimination, bullying, or hostile behavior toward other users is strictly prohibited and will result in account suspension or termination.

You agree to use Mind Wellness only for lawful purposes and in accordance with these terms. Specifically, you agree not to use the application to transmit any unlawful, abusive, defamatory, or obscene content.

Prohibited uses include but are not limited to: attempting to gain unauthorized access to the system or other users' accounts, disrupting the normal operation of the service, interfering with other users' experiences, uploading viruses or malicious code, and collecting or tracking personal information of others without consent.

You agree not to engage in automated data mining, scraping, or harvesting activities. Bots, crawlers, and automated tools are not permitted on the Mind Wellness platform.

The following activities are strictly prohibited on Mind Wellness:

• Accessing or attempting to access accounts without authorization
• Impersonating other users or misrepresenting identity
• Uploading or sharing illegal content
• Harassing, threatening, or bullying other users
• Spamming, phishing, or sending unsolicited messages
• Distributing malware, viruses, or harmful code
• Circumventing security measures or restrictions
• Reselling access or services to third parties
• Using the service for commercial purposes without authorization
• Engaging in any form of fraudulent activity

Mind Wellness uses artificial intelligence and machine learning to provide personalized mental wellness insights and recommendations. Our AI is designed to support your wellness journey, not replace professional medical or mental health services.

AI-generated content and recommendations are provided "as-is" without warranties of accuracy, completeness, or suitability for your specific situation. You understand that AI systems can make errors, provide biased information, or generate inappropriate content despite safeguards.

You acknowledge that AI recommendations should not be considered professional medical or psychological advice. Always consult with qualified mental health professionals for serious concerns or mental health crises.

IMPORTANT: Mind Wellness is NOT a medical device, treatment, or substitute for professional mental health care. The application is designed for educational and wellness support purposes only.

Content provided through Mind Wellness, including AI insights, is not medical advice and should not be treated as such. We do not diagnose, treat, cure, or prevent any mental health disorder or medical condition.

While we strive to provide accurate and helpful information, we make no guarantees regarding the effectiveness of our services for any individual user. Results vary based on personal circumstances, commitment, and engagement with the platform.

You understand that mental wellness is a personal journey and that improvement requires consistent effort, openness, and sometimes professional support beyond what our platform provides.

Your privacy is extremely important to us. All personal information collected through Mind Wellness is subject to our comprehensive Privacy Policy, which is incorporated by reference into these terms.

We employ industry-standard encryption and security measures to protect your data. However, no system is 100% secure, and we cannot guarantee absolute protection against unauthorized access or data breaches.

Mind Wellness offers both free and premium subscription tiers. Pricing for premium services is displayed clearly before purchase. All prices are subject to change with 30 days' notice.

You authorize Mind Wellness to charge your selected payment method for any subscription purchases you make. Payment information is processed securely through third-party payment processors and is never stored on our servers.

You are responsible for keeping your payment information current and accurate. If a payment fails, we will make reasonable attempts to process it again, and repeated failures may result in suspension of premium services.

All charges are non-refundable except as required by applicable law or as specified in our Refund Policy.

Premium subscriptions provide access to advanced features including unlimited AI analysis, personalized wellness plans, priority support, and exclusive content.

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription anytime through your account settings.

Your subscription is personal and non-transferable. Sharing your premium account with others violates these terms and will result in account termination without refund.

Mind Wellness offers a 7-day money-back guarantee for new premium subscriptions. If you are not satisfied with your purchase, you may request a full refund within 7 days of your initial payment.

Refund requests must be submitted through our support portal with a brief explanation. We will process approved refunds within 5-10 business days to your original payment method.

Refunds are available only once per user per calendar year. Abuse of the refund policy may result in denial of future refund requests and account suspension.

After 7 days, subscriptions are non-refundable but can be canceled anytime. You will not be charged for future billing periods once canceled.

You may terminate your account at any time by requesting deletion through your account settings. We will delete all personal data within 30 days, subject to legal retention requirements.

Mind Wellness may terminate or suspend your account immediately if you violate these terms, engage in prohibited activities, or pose a risk to other users or our service.

Upon termination, your access to all paid and free services ceases immediately. We are not responsible for any data loss or inability to access previously stored information.

Mind Wellness may temporarily suspend your account if we detect suspicious activity, security concerns, or potential violations of these terms. Suspended accounts cannot access the service but may be restored after investigation.

We will make reasonable efforts to notify you of suspension reasons unless notification would compromise security investigations. You have the right to appeal suspension decisions through our support process.

Suspension decisions are final after 30 days of investigation. Repeated violations may result in permanent account termination.

All content on Mind Wellness, including text, graphics, logos, images, audio, and video, is the property of Mind Wellness or its content providers and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, transmit, modify, or create derivative works of any content without explicit written permission from Mind Wellness.

Trademarks and logos displayed on Mind Wellness are registered and unregistered trademarks of their respective owners. You may not use these marks without proper authorization.

Mind Wellness grants you a limited, non-exclusive, non-transferable license to access and use the application for your personal, non-commercial wellness purposes.

This license is personal to you and cannot be shared, sold, or transferred. You agree not to reverse engineer, decompile, or attempt to derive the source code of Mind Wellness.

The license is revoked immediately upon violation of these terms or upon account termination for any reason.

Mind Wellness implements robust security measures including encryption, secure authentication, regular security audits, and compliance with industry standards to protect your data.

However, no security system is impenetrable. You acknowledge that despite our best efforts, data breaches may occur. We maintain cybersecurity insurance and incident response procedures to address any breaches.

In case of a security incident affecting personal data, we will notify affected users within 72 hours as required by applicable data protection laws.

You are responsible for maintaining the security of your account credentials and immediately reporting any suspected unauthorized access.

Mind Wellness strives to maintain continuous service availability. However, we do not guarantee uninterrupted access. Scheduled maintenance windows, updates, and unforeseen technical issues may cause service interruptions.

We will make reasonable efforts to notify users of planned maintenance in advance. Emergency maintenance may occur without notice if necessary to protect system security or data integrity.

During maintenance or service interruptions, premium subscription fees do not accrue time credits or refunds. You accept this limitation as part of service access.

Mind Wellness may integrate with or link to third-party services, applications, websites, and content providers. We are not responsible for the content, practices, or policies of third parties.

Your use of third-party services is governed by their terms and privacy policies. We encourage you to review these policies carefully before providing information or accessing external services.

Mind Wellness is not liable for any damages or issues arising from your use of third-party services or links. Your interactions with third parties are entirely your responsibility.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MIND WELLNESS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE USER TO MIND WELLNESS DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

You agree to indemnify, defend, and hold harmless Mind Wellness and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your violation of these terms, your use of Mind Wellness, or your infringement of any third-party rights.

Mind Wellness will provide notice of any indemnifiable claim and will cooperate in your defense. You agree to settle claims only with our prior written consent.

Mind Wellness shall not be liable for failure to perform any obligation under these terms if such failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, or major infrastructure failures.

In the event of force majeure, Mind Wellness will make reasonable efforts to resume service and will communicate any service impacts to affected users.

Any dispute, controversy, or claim arising from or relating to these terms or your use of Mind Wellness shall be resolved through binding arbitration rather than litigation, except for certain claims as outlined below.

Before initiating arbitration, both parties agree to attempt resolution through good-faith negotiation for 30 days. If negotiation fails, the dispute will be resolved by a single arbitrator under The Arbitration and Conciliation Act, 1996 (India).

The arbitration shall be conducted in English and the seat and venue of arbitration shall be Sangrur, Punjab, India.

EITHER PARTY MAY OPT OUT OF ARBITRATION BY SENDING WRITTEN NOTICE TO MIND WELLNESS WITHIN 30 DAYS OF FIRST ACCEPTING THESE TERMS.

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of Sangrur, Punjab, India.

You irrevocably submit to the exclusive jurisdiction of the courts in that jurisdiction for any legal action or proceeding arising from these terms or your use of Mind Wellness.

Mind Wellness reserves the right to modify these Terms and Conditions at any time. Significant changes will be communicated to users via email and through the application at least 30 days in advance.

Your continued use of Mind Wellness after any modifications constitutes acceptance of the updated terms. If you disagree with any changes, you may terminate your account and discontinue use.

The current version of these terms is always available on our website. We recommend reviewing these terms periodically to stay informed of any updates.
